SPECIAL MEETING AND PUBLIC HEARING TO SET 2016 AD VALOREM TAX RATE

Mayor Mary Schneider called the meeting to order.

A public hearing (as required under Kentucky Revised statutes) to collect comments and testimony for and against and ordinance setting its tax rate on real property for the 2016-2017 fiscal year.

C.A.O. Leidgen conducted the roll call.  A quorum of the Commission was present.

No guests were present for the public hearing.

 

City Attorney John Singler stated the purpose of the public meeting is to set the City’s 2016 tax rate at .174.  A Public Hearing notice was placed in the Courier-Journal as required by KRS 132.027.

Commissioner Jackson made a motion to close the Public Hearing and open the Regular Commission Meeting. His motion was seconded by Commissioner Hubbuch. The motion passed unanimously.

 

                                   

 

 

 

 

 

 

 

 

 

 

                                                REGULAR COMMISSION MEETING

September 27, 2016

The Pledge of Allegiance was led by Mayor Schneider.

RECOGNITION OF GUESTS

No guests were present.

Commissioner Jackson made a motion to add Ordinance 16-05 to Business Items under the Regular Commission Meeting. His motion was seconded by Commissioner Hubbuch; motion passed unanimously.

APPROVAL OF MINUTES

After a minor correction, Commissioner Wells made a motion to approve the amended September 13, 2016 meeting minutes. Commissioner Hubbuch seconded the motion; motion carried unanimously.

BUSINESS ITEMS 

Municipal Order 16-19 relating to Check Register Approvals for August 2016 was placed on the table for discussion.   Commissioner Hubbuch made a motion to approve MO 16-19.  His motion was seconded by Commissioner Jackson; motion carried unanimously.

City Attorney Singler held second reading of Ordinance No. 16-05 “AN ORDINANCE RELATING TO THE ADOPTION OF THE CITY OF HURSTBOURNE AD VALOREM TAX ASSESSMENT AND THE LEVYING OF AD VALOREM TAX THEREON FOR CITY PURPOSES FOR THE FISCAL YEAR ENDING JUNE 30, 2017”.  As summarized by Attorney Singler, The property tax rate was lowered to $0.174 per $100.00 in assessed values. Commissioner Jackson made a motion to approve Ordinance 16-05. His motion was seconded by Commissioner Hubbuch. Roll call vote was taken:  Mayor Schneider—yes, Commissioner Hubbuch—yes, Commissioner Jackson—yes, Commissioner Wells—yes and Commissioner Wagner—yes.  Ordinance No. 16-05 was enacted by a 5-0 vote.

ATTORNEY’S REPORT –

City Attorney Singler asked if the Commissioners had any questions regarding the proposed Ordinance 16-08, Series 2016 “AN ORDINANCE RELATING TO REGULATION OF ANY CUTS, OR CONNECTIONS, TO THE CITY OF HURSTBOURNE RIGHT OF WAY AND CREATING AN ENCROACHMENT PERMIT PROCESS.”

Commissioner Jackson made a motion for first reading of Ordinance 16-08, Series 2016.  His motion was seconded by Commissioner Hubbuch; motion carried unanimously. After discussion, Commissioner Wagner requested that the Hurstbourne Historic Mix language be added to the Ordinance in order to retain uniform composition and coloring of concrete on all sidewalk repairs.

Commissioner Hubbuch asked if the City has an ordinance that covers dead trees in citizen’s front yards.

City Attorney Singler stated that there is a nuisance order regarding dead trees that presents a danger. A letter can be sent to the homeowner regarding this problem; however, it was suggested that Horticulturist Andrea Hanlon first make a determination on the tree’s condition.

TREASURER’S REPORT – Treasurer Bennett

City Treasurer Bennett reported the auditors are making year end changes in the financials which may reflect moderate changes.  After Commissioner Jackson questioned a couple of items, Mr. Bennett stated that after the auditors make certain adjustments, the items in question will be clarified.

CITY ENGINEER – Engineer Crumpton

City Engineer Mr. Crumpton gave an update on the Hurstbourne Storm Water Advisory Committee (HSWAC). There was a follow up meeting with MSD to discuss implementation of their report regarding storm water analysis. However, MSD does not have a designated person appointed for the committee to interact with at this time.

The Linn Station entrance is looking good and still waiting for the wrought iron fencing plus the stone caps to be delivered.

The sidewalk shavings are delayed due to scheduling.

Mr. Crumpton presented the Friday, September 23, 2016 bid opening results for repaving. The bids were: MAC Construction –$116,229.07, Hall Contracting–$125,825.50, and Flynn Brothers–$152,213.46.

Mr. Crumpton discussed the introduction of Kevlar that is to be applied only to the commercial streets of Whittington Parkway and Liberty Bank Lane/Blairwood Road. This product includes certain fibers which gives the asphalt mixture additional binding strength.  After a discussion, a motion was made by Commissioner Wells to accept the MAC Construction bid of $116,229.07 and apply the Kevlar mix to Rugby as well. The paving project is not to exceed $120,000. His motion seconded by Commissioner Hubbuch; motion carried unanimously.

NEW BUSINESS 

Commissioner Hubbuch, C. A. O. Leidgen, and City Engineer Crumpton introduced a proposal of placing an entrance sign at Blairwood Access Way near Ken Towery. Mr. Crumpton added that encroachment permits would have to be obtained from the state. This would take approximately six months. Commissioner Hubbuch distributed illustrations of a sign that included a refurbished section. The sign would cost approximately $2900. Concepts of using urns in other parts of the City were also discussed.  After discussion, Mayor Schneider suggested the placement of entrance signs and urns be deferred until a later date. 

ADMINISTRATOR’S REPORT – C.A.O. Leidgen

Mr. Leidgen distributed his C. A. O. Management Report.

C.A.O. Leidgen made a presentation regarding the choice of gold or black lettering on the Linn Station entrance. The cost for gold lettering is $3500 from Fast Signs. After much discussion, a motion was made by Commissioner Hubbuch to place gold lettering at the entrance; his motion seconded by Commissioner Jackson. Motion carried unanimously.

Mr. Leidgen spoke with the occupants of 9100 Paragon Place about a non-permitted structure.  The owners of the building are located in Miami, Florida and he will continue to pursue this violation.

In addition, Mr. Leidgen presented a picture of a leaning brick wall at Wessex Place.  After much discussion, this wall does present a hazard and the ownership needs to be determined by a survey.

MAYOR’S REPORT

No Report.

PUBLIC WORKS REPORT – Commissioner Wells

Commissioner Wells asked the other Commissioners if they had considered an amount of money they were willing to commit annually for storm water and to get MSD’s attention on their priority list. Commissioner Wells stated that he would support a commit of $100,000 per year for a period of five years. With the upcoming budget, he suggested that $70,000 could come from Public Works, $10,000 from Code Enforcement, $15,000 from General Government and $5000 from Public Safety.

Commissioner Hubbuch was not in agreement with contributing these figures since future Commissioners may inherit this commitment. Commissioner Jackson agreed, and added that the City budget currently has $100,000 that can be contributed this year. He complimented Commissioner Wells and City Engineer Crumpton for their outstanding efforts with MSD.

A 5K walk is scheduled for 8:30 a.m. on October 29th.  This information should be announced on Reach Alert on October 27th for the citizens’ convenience. The police and JCPS will provide safety patrols to be present.

Tree removals have been identified and bid accepted.  The work will start soon.

The attendance at the picnic on September 25 at Lowe Elementary School was not as high as the previous year and was likely due to the hot weather and the lack of a Reach Alert notification to residents. If heat is predicted next year, fans will be rented for inside the tent.  The fire truck was a big hit with the children and parents alike.  

PUBLIC SAFETY – Commissioner Hubbuch 

Commissioner Hubbuch reported that a mailbox at 1017 Colonel Anderson Parkway was knocked down and the owner was attempted to be notified.

Street stripe painting companies will be contacted to quote on painting stop bars.

GENERAL GOVERNMENT REPORT – Commissioner Jackson

Commissioner Jackson asked C. A. O. Leidgen about the two dates chosen for the HABA event on November 15 and 16 evening. Mayor Schneider replied that these dates were good for her and will she check with Metro Councilmember Marilyn Parker. He asked that the “Lunch and Learn” on October 11th be placed on the website.

The tenant lease to Neel Schaffer lease in October and their current rent is $2100 monthly.  Options were presented to them regarding the lease term and lease rate. There will be an update at the next meeting.

Commissioner Jackson asked C. A. O. Leidgen to research the policy of paying for Victoria Lemke’s life insurance policy. Mr. Leidgen explained the history of how the former Commissioners came to this agreement.  Mayor Schneider reported that she called a brokerage company and Joan Peak of Nelson Insurance to quote prices for various amounts of life insurance for the staff. Commissioner Hubbuch then suggested that this topic be tabled until the next meeting.

No report.
