Mayor Bob English called the meeting to order.
ROLL CALL
C.A.O. Leidgen conducted the roll call. Present were: Mayor English; Commissioners Ed Dahlem, Dick Hays, Earl Hubbuch and Lois Wagner; Attorney John Singler; and C.A.O. Jim Leidgen. Treasurer Bill Bennett was not in attendance. A quorum of the Commission was present.
PLEDGE
The Pledge of Allegiance was led by Mayor English.
RECOGNITION OF GUESTS
John Harper and John Ashton, representatives of Louisville Gas & Electric Company, were present
to discuss recent power outages in Hurstbourne, specifically on Nottingham Parkway. They explained that outages may be caused by a variety of reasons, including equipment failure because of storms. On Nottingham, there have been as many as five (5) failures over the past year, and they are investigating what the cause might be. Several underground cables have been replaced and they are investigating other potential causes. They expressed their concern for the residents who are suffering the power failures, and stated they will continue to work to solve the problem.
Ron Allen of 9428 Wessex Place received a recent “courtesy reminder” about vehicles which he has
been parking on the street. He explained that he has a two-car garage but three vehicles and one must be parked on the street. The notice had been sent by the President of the Wessex Place Homeowners Association and it quoted a City ordinance. Mr. Allen explained that he didn’t understand why he received the notice and didn’t think he was in violation of the city’s ordinances. C.A.O. Leidgen explained that Wessex Place is the one exception to the City’s parking ordinance since they do not have driveways on which to park additional vehicles. Commissioner Wagner asked C.A.O. Leidgen to notify the President of the Wessex Place Homeowners’ Association that they should not use City ordinances for any restrictions they use regarding parking since they are specifically restricted from the city’s ordinance. Attorney Singler stated that an individual who has a deed with the restrictions of the Homeowners’ Association has contracted away some personal rights and must abide by their regulations; however, the Association cannot regulate city streets.
John Aubrey with Kentuckiana Law Enforcement was present to discuss the contract the City has
signed with them for police protection beginning in October. His company has been in business for nineteen (19) years and they currently manage about 6000 hours of off-duty police services. They will handle all of the logistics of scheduling, invoicing, and payroll. However, the City of Hurstbourne can specifically manage police officer patrols and primary duties. These officers will be off-duty Metro Police officers will full police powers. Mr. Aubrey also stressed that residents should always call Metro PD direct; 9-1-1 for emergencies and 574-2111 (Option 5) for non-emergencies.
APPROVAL OF MINUTES
Commissioner Dahlem made the motion to approve as distributed the minutes of the August 28, 2012 regular meeting of the City Commission; his motion was seconded by Commissioner Hays. Motion carried.
BUSINESS ITEMS
Ordinance # 12-05 Defining Duties of City Commissioners and Ordinance # 12-06 Adopting a Financial Management and Investment Policy were on the agenda for second reading and passage. Commissioner Hubbuch stated that he has not had time to study these ordinances and made the motion to table them until the next Commission meeting. After discussion, Commissioner Hays seconded his motion. Motion carried.
ATTORNEY’S REPORT – Attorney Singler
Attorney Singler reported that a home in foreclosure on Buckingham has a Commissioner sale date set for next Tuesday, September 18th. He also said that he conduct research to determine why there has been no action on the Kaplan foreclosure case.
ADMINISTRATOR’S REPORT – C.A.O. Leidgen
C.A.O. Leidgen stated that he took it upon himself to take down many of the non-essential directional signs that were designated and approved to be removed. He said the City streetscapes look much neater and uncluttered.
Mr. Leidgen and City Engineer Chris Crumpton are working on this year’s funding application for the ADA Sidewalks project and will forward that to Louisville Metro Councilmember Jon Ackerson as soon as possible. Advertisement for Bids on this project was listed in the Louisville Courier Journal.
Mr. Leidgen asked the Commissioners to give him suggestions for the next newsletter.
In discussions about the next City directory, C.A.O. Leidgen asked the Commissioners to consider adding an alphabetical listing to the street listing that has been used in the past. The Commission agreed with this, and Mr. Leidgen said he will try to get the directory out in October.
The new traffic signs and hardware have been ordered and should arrive for installation within 6-8 weeks from order date.
Mr. Leidgen had a brief meeting with the Lowe Elementary School PTA president, the new principal, and another parent. Every few years they conduct their Health Fair and “Leopard LOOP Walk.” This year it will be held on September 27/28, and they would like to recognize the City of Hurstbourne at that time for their donation given to them for new playground equipment.
The home in the City that was donated to the Lyndon Fire Department for training has now been demolished and plans for new construction have been approved by Hurstbourne and Metro Planning and Zoning. Construction should begin soon.
MAYOR’S REPORT – Mayor English
Mayor English reported he received three complaints about folks who were shooting fireworks. Attorney Singler stated that even though there are ordinances against firing a certain class of fireworks, it is difficult to enforce them. It was suggested that the police be notified if this continues to occur.
PUBLIC WORKS REPORT – Commissioner Wagner
The city concert and picnic will be held on September 16 at 5:00 p.m. Commissioner Wagner presented a letter she had received from the Franciscan Shelter House thanking the Commission for the food which was given to them after the last picnic.
Commissioner Wagner reported that bids for the city’s paving came in at a higher amount than
projected. C.A.O. Leidgen stated that the unit price for “resurfacing existing pavement” of $58.65 per ton was still low in comparison to area market prices. The low bid was $566,883.70. The alternate low bid was $28,805.65. Flynn Brothers Paving was the low bidder. After some discussion, Mayor English made the motion to accept Flynn Brothers bid and alternate bid. His motion was seconded by Commissioner Wagner. Motion carried.
GENERAL GOVERNMENT REPORT – Commissioner Dahlem
Commissioner Dahlem said he would talk with Commissioner Hubbuch prior to the next Commission meeting about Ordinance #12-05 and Ordinance #12-06.
PUBLIC SAFETY REPORT – Commissioner Hubbuch
Commissioner Hubbuch referred to the City’s web page on wild animals advising residents that coyotes and other wild animals should not be fed.
CODE ENFORCEMENT/SANITATION REPORT – Commissioner Hays
Commissioner Hays reported that the City’s Junk Pickup Day is scheduled for Saturday, October 20. He stated that hazardous materials will not be picked up.
