Mayor Pro Tem Ed Dahlem called the meeting to order. Mayor English arrived a few minutes later and chaired the meeting.

RECOGNITION OF GUESTS
Mr. Dennis C. Dewitt of 800 Rugby Place and his architect, Jeffrey Smith of 5801 S. Watterson Trail, were present to ask for a variance to have a new garage constructed that would face the street on Rugby. After discussion, Commissioner Jackson made the motion to approve the variance; his motion was seconded by Commissioner Hubbuch. Motion carried.
Mr. Kevin Young of Land Design and Development and Mr. Tom Longshore of 905 Tamarisk Court were present regarding the proposed construction of a new Skyline Chili. Attorney Singler distributed a copy of the proposed Binding Elements for this project which includes an amended section regarding the pedestrian bridge and the requirement to maintain the bridge by the property owner. Attorney Singler presented Municipal Order 14-17 Series 2014 – A detailed development plan and amended binding elements for property located at 340 Whittington Parkway. Commissioner Hubbuch made the motion to approve MO 14-17; his motion was seconded by Commissioner Jackson. Motion carried.
APPROVAL OF MINUTES
Commissioner Wagner mentioned a minor error in the Minutes of September 24, 2014 and made the motion that those minutes be approved with the correction; her motion was seconded by Commissioner Jackson. Motion carried.

ATTORNEY’S REPORT – Attorney Singler
Attorney Singler reported the property on Paddington Court which has been in foreclosure will be sold on November 4.
ADMINISTRATOR’S REPORT – C.A.O. Leidgen
The next Hurstbourne Herald should be out around October 20.
MAYOR’S REPORT – Mayor English

GENERAL GOVERNMENT REPORT – Commissioner Dahlem
No report.
CODE ENFORCEMENT/SANITATION REPORT – Commissioner Jackson
Commissioner Jackson reported that the house on Lyndon Lane which was cited has a dumpster and they appear to be working on it.
The home on 9101 Nottingham Parkway now has grass and is looking much better. Commissioner Jackson requested that Atty. John Singler follow up on the status of the fees and penalties imposed on the property owner on behalf of the City and report back to the Commission at the next meeting.
Commissioner Jackson brought up certain service requirements contained within the sanitation contract. He also noted that the sanitation contract be put out for bid before the end of the current contract term. Rumpke should be notified in writing in March of next year.
PUBLIC SAFETY REPORT – Commissioner Hubbuch
Commissioner Hubbuch reported the sign on Whittington Parkway which had been knocked down is due to be replaced this week. The few remaining signs in the City to be upgraded should be completed this week.
PUBLIC WORKS REPORT – Commissioner Wagner
Commissioner Wagner reported the tree canopy program went well with 71 requests for trees. The original motion to approve the program only allowed for the purchase of 50 trees, and she felt the program should be extended to allow all those who asked to participate to do so. She made the motion to approve the purchase of all of the requested trees. Her motion was seconded by Commissioner Hubbuch. Motion carried.
Commissioner Wagner then advised the Commission of Tree City USA, set up by Arbor Day Foundation to inspire people to plant, nurture and celebrate trees. To qualify as a Tree City USA community, a town or city must: 1) Set up a Tree Board or Department; 2) Enact a Tree Care Ordinance; 3) Have a Community Forestry Program with an annual budget of at least $2 per capita; and 4) Have an Arbor Day Observance and Proclamation. She made the motion that Hurstbourne begin the process to comply with the requirements of this program. Her motion was seconded by Commissioner Hubbuch; motion carried.
City Engineer Chris Crumpton reported the ADA Sidewalk work on Col. Anderson is more than half completed.
Engineer Crumpton has been in touch with representatives of the Church of Jesus Christ of Latter Day Saints regarding the City’s request for an easement on a small section of church property on Hurstbourne Lane and will keep in touch with them.
The Department of Transportation stated that they do not have approved standards or specifications for breakaway masonry structures or signs. Mr. Crumpton will continue to work with them to determine the type of structural materials needed to meet breakaway requirements.
Mr. Crumpton reported that he received information which had been requested from MSD regarding the drainage models which will allow the city to use in order to identify and prioritize possible projects.
There was a discussion about the sound barrier wall along I-64 regarding any possible plans from the state to extend the wall westward from the existing wall.
C.A.O. Leidgen reported that he received letters from several businesses affected by lengthy turn signals on Hurstbourne Parkway at Williamsburg Plaza and Whittington Parkway. He delivered the letters to KYTC and stated that he will continue to stay in touch with the State and local elected officials in an attempt to have the signals modified to flashing yellow to improve traffic flow at these locations.
