MINUTES – REGULAR MEETING

Mayor Mary Masick called the meeting to order at 4:30 p.m.

C. C. A. O. Tyler Johnson conducted the roll call. A quorum of the Commission was present.

The pledge of allegiance was led by Mayor Masick.

RECOGNITION OF GUESTS
Officer Steve Jesse, Lyndon Police was in attendance.
G. Perry Adelman addressed the Commission regarding her campaign for the State House. She stated she
withdrew from the Democratic party and is running as an Independent.

BUSINESS/ACTION ITEMS

APPROVAL OF MINUTES
The May 28, 2024 minutes were presented for approval. With a minor correction, Commissioner Norton
made a motion for approval of the minutes and his motion was seconded by Commissioner Leahy.
Motion carried unanimously.

City Attorney John Singler read a publicized notice stating this is a Public Hearing regarding the City
taxes ending in the year June 30, 2025. The floor was open for discussion, and no one spoke.
Ordinance No. 24-01—AN ORDINANCE RELATING TO THE ADOPTION OF THE CITY OF
HURSTBOURNE AD VALOREM TAX ASSESSMENT AND THE LEVYING OF AD
VALOREM TAX THEREON FOR CITY PURPOSES FOR THE FISCAL YEARS ENDING
JUNE 30, 2025.

After some discussion, Commissioner Jackson made a motion for approval of the second reading and
approval of Ordinance 24-01 changing the tax rate from .169 to .176. His motion was seconded by
Mayor Masick. Voice roll call vote was taken—Mayor Masick—yea, Commissioner Norton—yea,
Commissioner Jackson—yea, and Commissioner Leahy—yea. Ordinance 24-01 was enacted with a 4-0
vote.

Ordinance No. 24-02—AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE CITY
OF HURSTBOURNE FOR THE FISCAL YEAR JULY 1, 2024 TO JUNE 30, 2025 BY
ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE
OPERATION OF CITY GOVERNMENT.

After some discussion, Commissioner Jackson made a motion for second reading and approval of
Ordinance 24-02. His motion was seconded by Commissioner Leahy. Voice roll call was taken—Mayor
Masick—yea, Commissioner Norton—yea, Commissioner Jackson—yea, and Commissioner
Leahy—yea. Ordinance 24-02 was enacted with a 4-0 vote.

City Attorney John Singler discussed the proposed Ordinance No. 24-03—AN ORDINANCE
ADOPTING A POLICY FOR FAILURE TO OBSERVE STOP SIGNS AND SETTING
PENALITIES FOR VIOLATIONS.

Attorney Singler conducted a discussion regarding the issue that a stop sign violation is not a criminal
offense, and the City does not have the ability to reclassify it as such. Commissioner Norton made a
motion to table the ordinance with no further discussion. His motion was seconded by Mayor Masick.
Motion carried unanimously.

C. C. A. O. Tyler Johnson—Management Report
For discussion purposes, C. C. A. O. Tyler Johnson mentioned the upcoming transfer of $100,000 into the
Storm Water Account. Mayor Masick made a motion to transfer $100,000 from the City’s operating fund
into the Storm Water Account for the purpose of emergency or planned projects for the fiscal year 2025.
Her motion was seconded by Commissioner Jackson. Motion carried unanimously.

C. A.O. Tyler Johnson presented an estimate from Raatz Fencing for a fence to be installed behind the
hotels on Blairwood Road. He added that the hotels showed no interest in cost sharing of the fence. After
some discussion, Mayor Masick requested that Mr. Johnson research what type of fence Blairwood
Tennis Center currently has and how it has endured over the years. The concept is to match the tennis
center’s fence with the hotel fence.

In addition, C. A. O. Johnson presented a quote from Cornerstone Landscaping regarding tree removals or
trimming from various streets. The estimate includes a 10% discount if they can do the work
simultaneously. The amount comes to $10,305.00. Commissioner Norton made a motion to approve the
Cornerstone estimate at $10,305.00. His motion was seconded was Commissioner Leahy. Motion carried
unanimously.

Lastly, Mr. Johnson announced the 4 th of July Parade and stated the parade will be taking the same route
as last year. The St. Matthews Fire Department will lead the parade along with Lyndon and the St.
Matthews police departments.

COMMISSION REPORTS

MAYOR’S REPORT
Mayor Masick had no report.

PUBLIC SAFETY REPORT
– Commissioner Norton
Commissioner Norton discussed the May police report. He stated there were eighteen stop sign warnings,
six courtesy notices and one citation. In addition, he stated the speeding on Oxmoor Woods Parkway has
improved and the homeowners’ association is still interested in the placement of electric stops signs.

GENERAL GOVERNMENT REPORT – Commissioner Jackson
Commissioner Jackson inquired if the recent renter had moved into the upstairs office at City Hall.
C. A. O. Johnson replied he had paid the rent and the security deposit but had not occupied the office as
of this date.

PUBLIC WORKS – Commissioner Leavell
Commissioner Leavell was not in attendance; therefore, there was no report.

CODE ENFORCEMENT/SANITATION—Commissioner Leahy
Commissioner Leahy has no report.

CITY ENGINEER’S REPORT—Chris Crumpton
City Engineer Chris Crumpton distributed the estimates regarding the city’s road paving and the streets
that are involved. Also, he stated that part of the invoice will be paid from the American Rescue Plan Act
funds. The advertising and bid packets will go out sometime in July.

ATTORNEY’S REPORT – Attorney John Singler
City Attorney John Singler reported a letter was mailed to several business owners who were out of
compliance with their business licenses and sign fees. He will have a report on their response and status
of their violations at the next meeting.

TREASURER’S REPORT – Treasurer Mike Rhodes
City Treasurer Mike Rhodes was not in attendance; therefore, there was no report.
OTHER NON-BUSINESS/ACTION ITEMS
No further actions were taken.

ADJOURNMENT
At 5:38 p.m. Commissioner Jackson made the motion to adjourn. His motion was seconded by
Commissioner Norton. Motion carried unanimously.
