Mayor Bob English called the meeting to order.

ROLL CALL
C.A.O. Leidgen conducted the roll call. Present were: Mayor English; Commissioners Ed Dahlem, Dick Hays, Earl Hubbuch and Lois Wagner; Attorney John Singler; Treasurer Bill Bennett; and C.A.O. Jim Leidgen. A quorum of the Commission was present.

APPROVAL OF MINUTES
Commissioner Wagner made the motion to approve as distributed the minutes of the July 24, 2012 regular meeting of the City Commission; her motion was seconded by Commissioner Hays. Motion carried.

ATTORNEY’S REPORT – Attorney Singler
Attorney Singler reported that he has been working with Commissioner Hubbuch and C.A.O Leidgen on the police patrol issue. Commissioner Hubbuch reported on research pertaining to the possibility of the City using a private security company for police patrol in the City. Currently, the City has a contract with Louisville Metro Police to provide the services of off-duty police at a rate of $50 per hour. In addition to police patrols, there exists an independent agreement with a detective from District 8 to provide services to the City. Two of the largest firms which had been recommended by other cities were interviewed; Kentuckiana Law Enforcement, Inc. and Off-Duty Police Services, Inc. Commissioner Hubbuch emphasized that they were impressed by the professionalism and services provided by both companies. Each company would use off-duty officers who are familiar with the City. Either of the companies would charge less than LMPD per hour and would provide similar management reports as the City now receives. It was concluded that for the same dollars currently budgeted, the City would significantly increase police presence in the city. Commissioner Hubbuch went over some of the items the committee had discussed, including the client references, liability risk/coverage, and the sample contract. C.A.O. Leidgen referred to the management tools used by Kentuckiana Law Enforcement, including a website that the City can use for viewing individual officer reports, monthly officer shift postings, and monthly billing. Stating that either of these companies would do a great job for the City, the committee recommended for the Commissioners’ review: a) Enter into a Contract with Kentuckiana Law Enforcement at a rate of $35 per hour as stipulated in the agreement provided; b) The approval of Municipal Order 12-23; c) Termination of the present contract with Louisville Metro. After discussion, Commissioner Dahlem made the motion to adopt Municipal Order 12-23, A Municipal Order Cancelling the Interlocal Cooperation Agreement with Louisville Metro for Police Services and Approving a Professional Service Contract with Kentuckiana Law Enforcement for Police Services. Commissioner Dahlem’s motion was seconded by Mayor English. Motion carried. Commissioner Hubbuch expressed his appreciation to Attorney Singler and C.A.O. Leidgen for their efforts on this project.

ADMINISTRATOR’S REPORT – C.A.O. Leidgen
C.A.O. Leidgen referred to the recent article in the Courier Journal about the status of the Vinings property.

C.A.O. Leidgen spoke to Metro Councilman Jon Ackerson’s office about the proposed construction at the I-64/Hurstbourne Parkway interchange. In that conversation, it was reiterated that Mr. Ackerson plans to keep his commitment to participate in the expense of Hurstbourne’s construction of ADA Ramps / Sidewalks in the City.

A street light was damaged in a recent car accident and LG&E was quick to respond and replace it.

MAYOR’S REPORT – Mayor English
Mayor English said he has seen the plans for the projected improvements at entrances and was pleased with how they look.

PUBLIC WORKS REPORT – Commissioner Wagner
Commissioner Wagner said that power seeding on some of the medians will begin in the near future.

Mayor English asked Commissioner Wagner to get an estimate on how much it would cost to pave all of
the city streets. At Commissioner Wagner’s request, City Engineer Chris Crumpton presented to the Commission a map with estimates to pave the City’s major arterial streets, including both sides of Colonel Anderson Parkway from Bedfordshire to Fulham, both sides of Linn Station Road from Oxmoor Woods entrance to the end, both sides of Oxmoor Woods Parkway from Linn Station to South Lyndon, partial paving on each side of Nottingham Parkway from Dennington to Seaton Springs to Linn Station, and the South side of Nottingham Parkway from Oxfordshire to South Lyndon. The estimate for the above listed work and other miscellaneous items was $396,000. He emphasized that this would be an excellent opportunity to obtain favorable pricing as it appears that demand is soft and contractors are looking for work. After discussion, Commissioner Hubbuch made the motion to authorize Mr. Crumpton to proceed with the advertisement to receive bids for these streets. His motion was seconded by Commissioner Wagner. Motion carried.

GENERAL GOVERNMENT REPORT – Commissioner Dahlem
Commissioner Dahlem reported that the Investment Committee had met and looked at the City’s investments and what should be done with those funds. The City has approximately $2.3 million on deposit with various banks with about $900,000 maturing within the next two months. The committee decided they would prefer to keep those investments in banks within the City of Hurstbourne, making certain that the funds will be fully guaranteed. He also has asked Attorney Singler to draft an ordinance that would adopt a financial management and investment policy for the City of Hurstbourne in accordance with state law.

Because of recent discussions about the specific duties of Commissioners, Commissioner Dahlem had asked Attorney Singler to draft an ordinance which would describe or define those duties. He presented Ordinance # 12-05, An Ordinance defining the Duties of each City Commissioner to Supervise Departments within the City Government. He asked the Commissioners to study this and give him any suggestions prior to first reading of the ordinance at the next Commission meeting.
