October 10, 2017

Mayor Mary Schneider called the meeting to order at 3:30 p.m.  The meeting time had been changed in order that the Commission could attend a public hearing relating to the widening of Hurstbourne Lane.

C.A.O. Leidgen conducted the roll call.  A quorum of the Commission was present.

RECOGNITION OF GUESTS
Anna Vantilburg, project manager for United Parcel Service (UPS) in Louisville, was present to discuss their request to operate a temporary holiday package delivery system in the City of Hurstbourne.  They have identified Hurstbourne Christian Church and Hurstbourne Baptist Church as two possible sites for their pods which would allow them to service this area by golf carts.  The drivers will be UPS employees who they are hoping to hire locally.  She explained the safety features of the golf carts and their reasons why this would be advantageous for UPS as well as local residents.
John Talbot representing Jefferson Development was present to discuss and answer questions relating to their request for an amendment to Binding Element #33 pertaining to the maximum height of light poles on lots 1 and 2 of the Vinings Apartments.  Commissioner Hancock stated that the Wessex Place Homeowners were fine with the amendment since Jefferson Development Group has agreed to place shields on the lights.
APPROVAL OF MINUTES
Commissioner Jackson requested that the minutes of the September 12, 2017 Commission meeting reflect that he asked for Public Works to look at the sidewalks in Oxmoor Woods Estates for cracks and sidewalk deflection and also to look at and clean the mold on their brick wall and entrance.  He then made the motion that those minutes be approved after that addition is made.  His motion was seconded by Commissioner Hancock; motion carried unanimously.
BUSINESS ITEMS
Ordinance 17-5, An Ordinance Prohibiting Short-Term Rental in the City of Hurstbourne was placed on the table for second reading and adoption.  There was discussion about the amount of fine to be assessed for those in violation of the ordinance.  Commissioner Jackson made the motion to approve second reading of Ordinance 17-5; his motion was seconded by Mayor Schneider.  Mayor Schneider called for a roll call vote – Mayor Schneider and Commissioners Hancock, Jackson and Wagner all voted yea and Ordinance 17-5 was adopted on a 4-0 vote.
Ordinance 17-6, An Ordinance Regulating Golf Carts and Low-Speed Vehicles in the City of Hurstbourne was given first reading by Attorney Singler.  The hours and days of operation were set from 9:00 a.m. to 5:00 p.m. from Nov. 1 thru Dec. 31. Commissioner Jackson made the motion for introduction and first reading of Ordinance 17-6; his motion was seconded by Mayor Schneider.  Motion carried unanimously.
Municipal Order No 17-38 Relating to Binding Element Amendment for Vinings Apartments Development was placed on the table for discussion.  This MO revises Element #33 regarding the height of the light poles at the Vinings Apartments and also specifies that they must comply with the shielding on those poles by November 30, 2018.  Commissioner Wagner made the motion to approve MO 17-38; her motion was seconded by Commissioner Jackson.  Motion carried unanimously.
COMMITTEE REPORTS, JOBS IN PROCESS, SPECIAL PROJECTS AND EVENTS
Mayor Schneider reported that it was stated at the Jefferson County League of Cities meeting that MSD would like to again discuss a proposed rate hike.  This will be discussed further at future meetings.
City Engineer Chris Crumpton reported on future sidewalk work and estimates from Precision Concrete for certain areas where the sidewalks have risen.  The estimates are for areas where the rise is more than ½” and from ¼” to ½”. Mr. Crumpton said he would recommend only doing the areas that are higher than ½”.  Attorney Singler said that even though the estimate is more than the amount that is required to be bid out, he has verified through the Kentucky League of Cities that Precision Concrete is the sole source for this service in the immediate area for this type work.  It was decided to postpone this decision until a future date.
C.A.O. Leidgen reported he will be meeting with representatives from Weathermatic regarding the irrigation upgrades.
There was a discussion about various committees.  C.A.O. Leidgen stated that since there are usually no more than two Commissioners on a committee, when one commissioner is absent that committee becomes non-functioning.  There also was discussion as to whether the City should go back to having a horticulturist.  After much discussion, Mayor Schneider made the motion to assign Commissioner Wagner to the Landscape and Plantings Committee; her motion was seconded by Commissioner Jackson.  Motion carried unanimously.
