MINUTES – REGULAR MEETING

City Clerk Nicol Mercado conducted the roll call. A quorum of the Commission was present.

RECOGNITION OF GUESTS
No guest speaker made a presentation to the Commission.
BUSINESS/ACTION ITEMS
Commissioner Leavell entered the Commission Chambers at 4:39 pm.
APPROVAL OF MINUTES
The April 14, 2026, Commission Meeting minutes were presented for approval. Commissioner Jackson made a motion for approval of the minutes with one correction. Motion was seconded by Commissioner Leavell. Motion carried unanimously.
APPROVAL OF DEPARTMENTAL ACH EXPENSES
After reviewing the departmental ACH expenses, Commissioner Jackson made a motion to approve the payments for processing by the Financial Manager. Commissioner Leahy seconded the motion, and the motion passed unanimously.
BUILDING PERMIT – 9001 Seaton Springs Parkway
After review of the application and all materials provided, Commissioner Jackson made a motion to approve the building permit application. Motion was seconded by Commissioner Leahy. Motion passed unanimously.
BUILDING PERMIT – 400 Edinburgh Place – Garage Addition
Current application for construction was proposed within five feet of the adjacent property line. After reviewing the application, all materials provided, as well as commentary from neighboring resident at 402 Edinburgh, Commissioner May made a motion to table the permit application as submitted. Motion was seconded by Commissioner Jackson. Motion passed unanimously. Applicant will attempt to revise plans to better conform to Hurstbourne design standards and setbacks.
BUILDING PERMIT – 9001 Seaton Springs Parkway
After review of the application and all materials provided, Commissioner Jackson made a motion to approve the building permit application. Motion was seconded by Commissioner Leavell. Motion passed unanimously.
BUILDING PERMIT REVIEW – Hurstbourne Country Club – Nottingham Parkway fence Hurstbourne Country Club was retroactively submitting a permit for the fence along Nottingham Parkway as they could not locate record of an approval from the City for the replacement of said fence in 2020. Prior to the building permit review, Commissioner Leahy recused herself from the discussion, leaving the Board of Commissioners table and exiting the Commission Chambers at 4:49 pm. A quorum remained present for the meeting.
City Attorney John Singler explained he has asked Commissioner Leahy to recuse herself due to her seat on the Governing Board of Hurstbourne Country Club. He gave his legal opinion that mere membership of the club does not in itself constitute an ethics violation. John Singler consulted with the Kentucky League of Cities attorney who handles the Certified City of Ethics training for the state, and they concurred. The KLC representative was of the same legal opinion that any member of the governing board for the club should recuse.
The fence in question had no official record of original construction and initial date of installation is unknown. The earliest verifiable date proving the fence’s existence is via a 2007 Google street view image showing the fence present. In 2020 the fence was in need of replacement. Per city ordinance, a 1:1 fence replacement did not require a building permit. The records located show the city approved the replacement via Commission Meeting minutes dated July 28, 2020, and also paid for the portion of the fence on the public right of way.
With the newly provided survey, it became apparent that a portion of the fence is located on the private property of a homeowner on Muirfield. The City Administrator will reach out to the homeowner and ask them if they wish to keep the fence. If so, the city will obtain a letter stating such from the homeowner, otherwise the city will pay for the removal of the portion of fencing encroaching on said private property.
After full discussion and review of all materials, the building permit was deemed unnecessary as the installation was previously approved.
BUILDING PERMIT REVIEW – Hurstbourne Country Club – Seaton Springs Parkway fence
Hurstbourne Country Club was retroactively submitting a permit for the fence along Seaton Springs Parkway as they could not locate record of an approval from the City for the replacement of said fence in 2015. The City Administrator was able to locate a ‘Letter of Compliance’ for the fence dated April 24, 2015, as well as Commission Meeting minutes dated April 28, 2015, showing where the building permit for the fence was approved by the commission at that time.
After full discussion and review of all materials, the building permit was deemed unnecessary as the installation was previously approved.
Following the completion of the discussion, Commissioner Leahy re-entered the Commission Chambers and the Board of Commissioners table as a voting member at 5:34 pm. A quorum was present for the meeting to continue.
ORDINANCE 26-02 AMENDING CHAPTER 153 SIGNAGE – First Reading
City Attorney John Singler presented for first reading Ordinance 26-02 AN ORDINANCE RELATING TO AMENDING CHAPTER 153 signage regulations. After discussion of the modified language as previously discussed, Commissioner Leavell made a motion to adopt the new revised Ordinance. His motion was seconded by Commissioner Leahy. A roll call vote was taken—Mayor Masick—yea, Commissioner Jackson—yea, Commissioner Leahy—yea, Commissioner Leavell—yea, and Commissioner May—yea. Ordinance 26-02, Series 2026 was enacted by a 5-0 vote.
M.O. 26-21 RELATING TO SURPLUS PROPERTY
M.O. 26-21 surpluses the old commission chamber chairs as well as a writing desk with plans for donation to a charitable organization. After brief discussion, Commissioner Jackson made motion to approve the M.O. Motion was seconded by Commissioner Leavell and the motion passed unanimously.
CAO TYLER JOHNSON – MANAGEMENT REPORT
CAO Johnson shared that the PVA sent out initial property values to the city. He will prepare tax rate calculations for review. He also shared that plans and designs are being drawn up for the new Veterans Memorial Flagpole installation and will be presented once the exhibit is available. The Oxmoor Woods Resident’s Association have requested to use the commission chambers for their annual meeting following the May 12 Commission meeting.The Commission agreed to allow the use of City Hall for that date. CAO Johnson reminded the Commission he would be out the following week for vacation but available if any emergencies arise.
COMMISSION REPORTS
MAYOR’S REPORT
Mayor Masick made the Commission aware the agenda for the America 250 event for July 3, 2026 was in the process of being made and would be presented at a future Commission meeting for review and approval.
GENERAL GOVERNMENT REPORT – Commissioner Jackson
Commissioner Jackson had no report.
CODE ENFORCEMENT/SANITATION – Commissioner Leavell
Commissioner Leavell had no report.
PUBLIC SAFETY REPORT – Commissioner Leahy
Commissioner Leahy shared the results of a meeting with Police Chief Rob Schroeder that focused on speeding in the area. Lyndon Police will continue to focus on reducing speeding and stop sign compliance. One of the speed radar signs will be relocated from Linn Station to Nottingham Parkway to gather a month of data prior to the new pedestrian lane painting project. Regarding Blairwood, cameras will be considered and investigated for potential installation. The old Bob Evans location is set to be leased by a new sushi restaurant. In the meantime ‘No Parking’ signs have been installed so that police can properly deter semi parking in the vacant lot. Those signs will be removed once the new restaurant tenant is moved in.
PUBLIC WORKS – Commissioner May
Commissioner May shared that public works items continue smoothly for the season with high expectations and the weather permitting goal of having plantings completed prior to Derby.
ATTORNEY’S REPORT – Attorney John Singler
City Attorney Singler had no report.
CITY ENGINEER’S REPORT – Chris Crumpton
City Engineer Crumpton made note he is still waiting for the surveys for the entrances. He also shared that he and the CAO have been working on a handout of standards to supply contractors who work within Hurstbourne and it should be available soon. Pricing was supplied for the pedestrian walking lane project with options for review. His recommendation would be to start with a section of street on S. Lyndon Lane to Seaton Springs as the first phase as a major stretch of road with no sidewalk.
TREASURER’S REPORT – Jerry Plappert
City Treasurer reported that the Budget to Actual review showed our revenue exceeded our budget and gave compliments to the team. The City Treasurer made mention that the newer LG&E street light poles were discovered to have some potential billing issues and he was working directly with the LG&E Billing Integrity Group to determine if there was an issue to be rectified.
